    Welcome to this forum. You want to know about Medical Leave. But for which category of employee? Do you want the information for State Govt. Employees? Or anything else. And one more thing, what do you want to know of Medical Leave?

    I am a School Teacher and want a discussion on M.L in details with illustration. My last attend in school was on 26.12.11 and 28.12.11 to 01.01.12 holidays. Then how many days will be my M.L. (a) If I join on 02.01.12, (b) Join on 03.01.12……

    Medical Leave availed of by the staff concerned of the School preceding or following the vacation is not to be counted for the vacation period provided he or she is present on either side of the vacation.

    If you join on 02.01.12 then the entire vacation will not be considered as ML, so, only 27.12.11 may be considered as ML. (1 day ML).
    If you join on 03.01.12 then total ML duration will be from 27.12.11 to 02.01.12 i.e. 7 days.
    This may be taken as an illustration; but i want to know how 28.12.11 to 30.12.11 are holidays.

    School was remained closed due to winter recess and new years day on and from 28.12.11 to 01.01.12 and reopened on 02.01.12. If last attend in school is on 27.12.11 and after short vacation 1st joining on 03.01.12 (New academic session-2012) then whether the date 02.01.12 will either be a (a) CL or (b) ML.

    On 02/01/12, either kind of leave may be taken. No bar in taking CL, because total absence does not exceed 7 days. Also, no bar in taking ML, only 1 day will be deducted. Doctor should certify that the patient is fit to perform his duty from 03.01.12.

    Whether it will be ML on 02.01.2012 as it is the 1st day of new academic session? Are there any rule on ML such this as our authority says that the 1st day on new academic session will be treated as ML due to one’s absent on that particular day?

    As this academic year starts from 1st January 2012, a total of 14 days CL (Memo No. S/104 dated 07.08.2009) will be credited to the account of the employee. Now you remain absent in the first day of the year. That’s why the problem in admissibility of CL. The authority is right here. You have to take ML for one day. And no need to give Medical Certificate for less than 3 days.

    Plz. mention circular/memo No of such right of the authority.Plz do not take it as an arguable matter.In this context, if one remain absent another 6 days(say,03.01.12 to 09.01.12=6 days absent and 02.01.12 remain present in school) except the 1st day of the academic session what will be the status of the above 6days .When CL is credited and after how many days CL is granted?
