    Regarding Casual Leave of The Primary Teacher.
    We know that, both the primary and secondary school teachers of the school may have 14 (fourteen) days casual leave in a year but it shall not entail an absence of more then 7(seven) consecutive days at a time including any holidays. The casual leave may be affixed or prefixed to any holidays. Those holidays and Sunday falling within the period of casual leave shall not be counted as a part of the casual leave.
    But what is a complete year for this purpose?
    In case of primary school teachers :- It will be count from 1st January to 31st December that means, during the calender year. vied Notification No.453-SE(Pry) Dated 04.05.1999. Government of W. B. School Education Department (Pry. Branch). But some of the Circle in W. B. count it on the basis of Academic Year. It is absolutely wrong. In case of Circle transfer of the teachers, they faced some problems.
    In case of secondary teachers:- According to Board’s circular, it will be count on the basis of Academic Year.
    Glad to know that, the ensuing academic year will start from 1st January like as calender year.

    Please clarify CL rule for pry teacher appointed on purely temporary basis.X’s joining date is 16.1.2010.He had to take leave for 3 days for semester exam(PG) at the end january’10.He applied chairman through HT&SI/S for study leave(or any kind of leave he pleases)as HT had refused to forward CL application as academic year complete in feb.HT put a note of absence on the monthly return.No response got from chairman bv got full salary.May the leaves be counted as CL?
    What are possible problems in future?

    Sir,
    Every Calender year a pry. teacher may enjoy 14 C.L. if he/she work the full calender year. I think the teacher enjoyed maximum 13 C.L. including those 3days during the calender year. that is why perhaps no problems arise in future. But study leave is not applicable here for the Pry. Teachers.

    DearSirs, I want to inform you that for CL no need to go to the Chairman. SI/S is the authorityto grant the CL. in Feb if the CL for certain is not available proportionately then it will be treated as Leave With Out pay if any other kind of leave is not in the credit. Mr. pal rightly said for primary teacher there is no provision for study leave.With regards.

    Many thanks to ASIT BABU & RABI BABU for your ans.But are the two ans same? CL of a new pry A.T.(fully temporary basis)is proportionate.What is it proportional to- is it no. of days between joining date & leave taking day
    OR no. of days left (from joining date) in the academic year
    OR days left in the calendar year?
    He enjoyed 12leaves(including those 3 days)upto31.1.11
    Being newly appointed he had no other leave in his account,is not it?

    He joined on 16.01.2010 i.e. in the academic year May, 2009 to February, 2010 (10 months) for which no of CL = 12 days.
    At the end of February the teacher could have enjoyed 1 day CL (calculating on proportionate basis and rounded off to nearest digit i.e. 1.38==1).
    So, application for 3 days CL is not granted. Only 1 day could have been considered as CL and 2 days could have been Leave Without Pay. This should be the actual procedure as per existing Govt. rules.
    Now it was the responsibility of the Head Teacher concerned to act as per Govt. rule. So, there is no fault of the employee himself. I think there will be no problem in future. Head Teacher should destroy the record of 2 days absence for his own sake.

    Sir,
    I think The latest G.O. Regarding Leave of Primary Teachers is No. 453 SE(Pry) dated. 04.05.1999. As per this Order C.L. will be count as per Calender year(i.e. January to December) not Academic Year. I have not yet found any order like Secondary Board’s Circular that have established Academic Year. Perhaps it has Published. Please post here the Order as early as possible to clear my confusion.

    THANKS WBXPRESS FOR YOUR REPLY. AND ALSO THANKS TO Mr A.B.PAL. I THINK WHAT Mr PAL HAS SAID THAT THE LATEST G.O.(IF THERE IS ANY) MAY END THE CONFUSION IS ABSOLUTELY CORRECT.HOPE TO GET THE G.O. AT THE EARLIEST FROM OUR FRIENDS.AND IF THERE IS NO SUCH G.O.,ANY LOGICAL/LEGAL OPINION IN THIS REGARD ARE WELCOMED.
