An employee has been taking medical leave frequently and submits a medical certificate every time which states that the employee has been suffering from Irritable Bowel Syndrome and hypertension. This has been been happening for the last two years prior to my joining this service. Now after calculation of her leaves it has been found that her leave account has turned ZERO as on 30th April 2016. ( combining her HPL and E.L). She absented herself again form office from 2/5/16 and joined office on 29/7/16 producing the medical certificate on the ground as mentioned before. Her pay was stopped from 1/5/16. Now the question how her pay shoudl be determined? Also how many days maximum is permissible for medical leave on production of medical certificate without being hospitalized?
An expedite reply is highly solicited as I am dire straits regarding this employee.
Without obtaining any application for EOL or at least an application mentioning or seeking the intention of agreeing to accept leave as admissible from the employee, it would not be correct on the part of administration to sanction EOL on suo motu basis.
