Sir,
This is a great opportunity for me ask questions regarding difficulties in my office, helping myself to find out the best solution through your advice.Remaining 50% of 3rd Installment of Arrear Pay & Allowances under ROPA’09 bill was prepared and submitted to the treasury for sanction and make payment. In the mean time one employee expired. Now what should I do? Remit the pay of the deceased employee to Treasury through T.R.Form-7, then prepare a fresh bill in the name of the nominee of the deceased employee OR is there any other way to make the payment to the nominee of the deceased?
Shall be in anticipation of your valuable advice.

I am taking you from my personal experience, as I dont know the exact rule. One employee expired after preparation of monthly salary bill but before ending of the month. The Office made calculation of his exact salary for that particular month and paid his wife as per her prayer but after receiving documentery proof of his death. The remaining amount refunded to the Govt. I think your case is quite similar and you can pay the amount to the family after receiving death certificate. As per rule 94 of CGA(R&P) Rules and specified in para 1.21 of the D.D.O’s Manual , “dues in respect of pay and allowances of all kinds claimed on behalf of a deceased Government servant upto and including the day of death may be paid without the production of usual legal authority,if the Head of Office is satisfied about the right of claimant. If the gross amount of the claim exceeds Rs.10,000/- payment may be made by Head of Office only on the execution of an indemnity bond in form GAR 26 duly stamped for the gross amount due for payment and after obtaining two sureties.” -
