He dear friend. Very sorry for the late reply. Its indeed a big mistake by the M.C. due to ignorance of the Govt. Orders and yes they should have knock the D.I. for soliciting instruction. However, whats the current status of the application. Is it till pending? If yes, Please tell me what kind of steps will you prefer? You may take legal action at any stage and I am sure it will be enough to shake the committee but this may be harmful in future as the matter of NOC is totally depends upon the wish of them.

Of the two teachers involved in a mutual transfer case who will be recommended by SSC for relieving first? What is the basis of such selection! Is it the date of registration with the Board’s website or else the date of submission of application!

It is extremely urgent to approach to the Govt ( I do not exactly know how / Some others may know and suggest ) for a bundle of fresh orders in respect of the changed situations and GOs from different offices like SSC, Board, DSE, as well as ROPAs and etc.I expressed my similar view regarding this before.
Now, the question under consideration : whether the MC has any power to make a teacher sign a contract before allowing him/her permission for B.Ed.
The answer is ‘YES’. The MC has been conferred with the power to do so. There is a GO also. There is a format also for the contract to be executed.
Therein, a teacher promises to serve the Institution from where he/she is being deputed to undergo B.Ed.training for the benefit of the students, for a period of 5 years from the last date of exam. or for 3 years from the publication of result, which ever is earlier.
Not only this, as far as I can remember, if the teacher resigns from the post before this period expires, he/she may have to refund the whole of deputation money to the govt. ( i.e. the money that was sanctioned to him/her at the time of deputation.)
But, I am sorry. I am out of home at present. So, I can not mention the number and date of the GO. I can provide the same after 2-3 days.
As for my own case :
I was appointed A.T. in 1997 and appeared at the SSC in 2000. In the same year (2000), I was admitted to B.Ed. after observing all the procedures at school. I was qualified in SSC and was recommended for the post of AT in a Higher Secondary School in 2001. I prayed for NOC which was not allowed on the ground of my contract.

I personally think, in such a situation, the teachers shall be allowed to change school WITHOUT refunding money incurred on B.Ed. course. The important point is that the teacher must have obligation to CONTINUE IN TEACHING PROFESSION in aided/sponsored schools at least for 3 yrs/ 5 yrs irrespective of the name of school. It hardly matters which school /MC recommends for deputation for B.Ed. In fact, all such schools run under the “Grants in Aid” scheme of the Govt. who pays the teachers. Govt. is spending money for proper mobilisation of its Human Resources like teachers etc. MC does not have any financial responsibilities.

Friend, I also believe there should be someone to bell the cat. But I don’t know how. Once i put a proposal for such kind of step by this very forum but that didn’t materialized.
besides, our friend Adil has put a proposal for source bank which also couldn’t be given form till now.
I think these discussion are worthy( though may not serve the purpose of the topic heading but it is really necessary to draw the attention of the law makers’ attention to the problem and this may be done by this forum…I dream….
